Terms and Conditions – Bazar Alward

Welcome to Bazar Alward.

These Terms and Conditions (the “Terms”) govern your use of the Bazar Alward Platform and the services provided through it.

By using our website, creating an account, or completing a purchase through the Platform, you agree to these Terms, together with the Privacy Policy, Shipping Policy, Return and Exchange Policy, Marketplace Intermediary Disclosure, and any other policies published or referenced on the Platform, all of which form an integral part of these Terms.

1. About the Platform and Nature of the Relationship

Bazar Alward is a multi-vendor electronic marketplace that enables Customers to browse and purchase products offered by independent Sellers registered and accepted on the Platform.

Bazar Alward Marketing Company owns and operates the Bazar Alward Platform. The Platform acts as an electronic intermediary facilitating the listing, marketing, and sale of products between Sellers and Customers.

Bazar Alward Marketing Company is not the direct Seller, manufacturer, supplier, or owner of products listed by independent Sellers unless expressly stated otherwise.

The sale of products listed through the Platform takes place between the Seller and the Customer. The Seller remains responsible for the products it lists, including their quality, conformity with their descriptions, and fulfilment of the obligations relating to those products, in accordance with applicable laws and the Platform’s policies.

Depending on the services available, the Platform’s role includes operating the electronic marketplace and facilitating product listings, ordering, payment, communication, shipping, Customer service, and the handling of complaints and order-related disputes.

Nothing regarding the Platform’s role as an electronic intermediary shall exclude any obligation or liability imposed on it by applicable law.

2. Company Information

3. Sellers on the Platform

Bazar Alward includes independent Sellers who offer their products for sale through the Platform.

The Seller associated with a product or order will be identified through the information displayed on the Platform.

Each Seller is required to provide the information and documentation requested by the Platform in accordance with its applicable registration and verification procedures.

The Platform reserves the right to suspend or remove a Seller or product where there is a violation of applicable laws or Platform policies, or where there are reasonable grounds to verify the Seller’s activities or the products being offered.

Acceptance of a Seller or allowing a Seller to use the Platform does not mean that Bazar Alward Marketing Company manufactures, owns, or guarantees all products offered by that Seller, without prejudice to any obligations imposed on the Platform by applicable law.

4. Products and Product Information

Sellers are required to provide accurate, correct, and non-misleading information about their products, including, depending on the nature of the product:

  • Product name and description.
  • Images.
  • Price.
  • Sizes.
  • Colours.
  • Materials and fabrics.
  • Specifications.
  • Product availability.
  • Preparation time.
  • Any other information required by applicable law or reasonably necessary for the Customer to make a purchasing decision.

The Platform may organize and review content displayed through the Platform. However, the Seller offering the product remains primarily responsible for the accuracy of product information, product quality, and conformity with its description, unless the error results directly from the Platform.

Colours displayed on a screen may differ slightly from the actual product due to screen settings, photography, or lighting conditions. Minor differences resulting solely from these factors shall not, by themselves, constitute a product defect.

This does not affect the Customer’s right to raise a complaint where the product materially differs from the description, images, or specifications displayed.

5. Prices, Taxes, and Fees

Product prices are displayed in Saudi Riyals (SAR).

Prices include Value Added Tax (VAT) where VAT is applicable under relevant laws and regulations.

Additional charges associated with an order, such as shipping or delivery fees or other applicable service charges, may be added provided that they are disclosed to the Customer before the purchase is completed where applicable.

The total amount payable by the Customer will be displayed before the order and payment are confirmed.

Where there is a clear and material pricing error resulting from a technical issue or incorrect data entry, the Platform or Seller may cancel the affected order. Any amount already collected for the cancelled product will be refunded in accordance with the payment method used and applicable laws and policies.

6. Orders and Formation of the Sale

When submitting an order, the Customer confirms that the information provided is accurate and complete, including the Customer’s name, mobile number, delivery address, order information, and payment method.

Submitting an order through the Platform constitutes a request to purchase the selected products from the relevant Seller.

Adding a product to the shopping cart does not reserve the product or guarantee its availability.

Receipt of an order electronically or the sending of an initial order confirmation does not necessarily constitute final acceptance or confirmation that the order will be fulfilled.

Fulfilment of an order is subject to payment verification, product availability, the Seller’s ability to fulfil the order, and the absence of any legal or operational reason preventing fulfilment.

An order or part of an order may be cancelled in circumstances including, without limitation:

  • The product is unavailable.
  • There is a clear and material error in the price or product description.
  • Payment cannot be verified or completed.
  • There are reasonable grounds to suspect fraud or unauthorized use.
  • The Seller is unable to fulfil the order.
  • A legal or operational reason prevents fulfilment of the order.

Where an order or part of an order is cancelled after payment has been collected, the amount due to the Customer will be refunded in accordance with applicable laws, the Return and Exchange Policy, and the payment method used.

7. Payment and Payment Processing

Bazar Alward Marketing Company, together with its approved payment service providers, facilitates the collection and processing of payments relating to orders made through the Platform and the settlement of Seller proceeds in accordance with the applicable arrangements.

Payment transactions may be subject to the terms and requirements of the relevant payment service provider, bank, or payment method issuer.

Customers must use a lawful payment method that they are authorized to use.

A transaction may be declined or cancelled if payment cannot be completed or if there are reasonable grounds to suspect fraudulent or unlawful activity.

The Platform does not store sensitive payment card information unless such storage is carried out in accordance with applicable laws and security standards through approved systems or service providers.

8. Shipping and Delivery

Available shipping options, applicable costs, and estimated delivery times will be displayed to the Customer before completing the order based on the information available.

Order preparation and delivery times may vary depending on:

  • The Customer’s location.
  • The Seller’s location.
  • Product preparation time.
  • The shipping provider.
  • The nature of the product.
  • Public holidays.
  • Seasonal or high-demand periods.
  • Circumstances beyond reasonable control.

The Platform may facilitate shipping through logistics companies or service providers contracted with or technically integrated into the Platform.

The Customer must provide an accurate delivery address and contact number and cooperate with the shipping provider where necessary.

The Platform shall not be responsible for delays directly resulting from:

  • An incorrect or incomplete address provided by the Customer.
  • The Customer failing to respond to the shipping provider.
  • The Customer delaying acceptance or collection of the shipment.
  • Circumstances reasonably beyond the Platform’s control.

Where a delay or failure to fulfil an order is attributable to the Seller, the matter will be handled in accordance with the Shipping Policy, Return and Exchange Policy, and the Customer’s applicable legal rights.

Nothing in this section limits any mandatory rights available to the Customer under applicable law.

9. Returns and Exchanges

Customers may request a return or exchange in accordance with Bazar Alward’s published Return and Exchange Policy and applicable laws in the Kingdom of Saudi Arabia.

The Return and Exchange Policy forms an integral part of these Terms.

Where applicable, returned products must be in their original condition, unused, and accompanied by their original accessories and packaging, subject to the detailed requirements of the Return and Exchange Policy.

The requirement for products to be in their original condition shall not prevent a Customer from exercising applicable legal rights where a product is defective, does not conform to its description, or an incorrect product has been supplied.

Certain products may be excluded from return or exchange because of their nature or because they were manufactured, prepared, or modified according to the Customer’s specific requirements, but only to the extent permitted by applicable law and as specified in the Return and Exchange Policy.

A product may not be treated as non-returnable where it is defective, does not conform to the agreed specifications, or where applicable law otherwise grants the Customer a mandatory right of return or exchange.

10. Defective or Non-Conforming Products

If a Customer receives a defective product or a product that materially differs from its description, specifications, or the product ordered, the Customer should contact Customer Service within the timeframe and in accordance with the procedures specified in the Return and Exchange Policy.

The Customer may be requested to provide photographs, information, or other reasonable evidence to assist in reviewing the issue.

The Platform will coordinate with the Seller to handle the request in accordance with the Platform’s policies and applicable laws.

The Seller remains responsible for defects, non-conformity, or product-related errors where responsibility is attributable to the Seller or the product supplied.

This does not exclude any responsibility imposed on the Platform by applicable law.

11. Refunds

Where a Customer is entitled to a refund as a result of a cancellation, return, or other applicable reason, the refund will be processed in accordance with the Return and Exchange Policy and the payment method used.

Refunds will generally be made through the original payment method where possible.

The time required for the refunded amount to appear in the Customer’s account may vary depending on the bank, payment service provider, or payment method used.

The Platform shall not be responsible for delays caused solely by the bank or payment service provider after the refund request has been processed by the Platform or relevant party, without prejudice to any mandatory obligations imposed on the Platform by applicable law.

12. Use of the Platform

Users must use Bazar Alward lawfully and only for its intended purposes.

Users must not:

  • Provide false, inaccurate, or misleading information.

Users must provide accurate and current information when creating an account.

The Platform may temporarily or permanently suspend, restrict, or close an account where:

  • These Terms are violated.
  • Unlawful use occurs.
  • There are reasonable grounds to suspect fraudulent activity.
  • Platform services are misused.
  • Action is necessary to protect Users or the Platform or to comply with applicable law.

14. Offers, Discounts, and Promotional Codes

The Platform or Sellers may offer promotions, discounts, or promotional codes subject to the specific terms applicable to each offer.

Offer conditions may include, for example, an expiry date, minimum purchase requirement, eligible products or Sellers, or limitations on the number of uses.

Promotional codes may not be transferred, sold, or used fraudulently unless the terms of the relevant offer expressly permit such use.

An offer may be modified or terminated before it is used in accordance with its applicable terms unless the Customer has already acquired an enforceable right under the offer or applicable law provides otherwise.

15. Complaints and Order-Related Disputes

Customers may contact Bazar Alward Customer Service regarding complaints relating to an order or product.

The Platform may intervene to facilitate the resolution of disputes between Customers and Sellers and may request relevant information or documentation from the parties involved.

Resolving a complaint may require coordination with the Seller, shipping provider, or payment service provider.

The Platform’s involvement does not prevent the Customer from exercising any applicable legal right or submitting a complaint to the relevant competent authority.

16. Limitation of Liability

To the extent permitted by applicable law, Bazar Alward Marketing Company shall not be responsible for indirect, incidental, or consequential losses arising from the use of the Platform or products supplied by independent Sellers.

The Seller is responsible for the quality, safety, and conformity of the products it supplies and for defects and product information where responsibility is attributable to the Seller.

The Platform shall not be responsible for acts or omissions of a Seller, shipping provider, or independent third-party service provider except to the extent that liability results directly from an act or omission of the Platform or is otherwise imposed by applicable law.

Nothing in these Terms shall be interpreted as excluding Bazar Alward Marketing Company from any liability that cannot legally be excluded or as limiting any mandatory consumer rights.

17. Intellectual Property

All rights relating to the Bazar Alward Platform, including its trade name, logo, design, software, Platform-owned text and content, and trademarks, are owned by Bazar Alward Marketing Company or used under licence from the relevant rights holders.

The Platform may also contain images, trademarks, and content owned by Sellers or other parties and used in accordance with the relevant rights or licences.

Users may not copy, reproduce, modify, distribute, publish, or commercially exploit Platform content without the prior written authorization of the relevant rights holder unless permitted by applicable law.

18. Privacy and Personal Data

The processing of personal data is governed by the Privacy Policy published on the Bazar Alward Platform.

The Privacy Policy describes, as required by applicable law, how personal data is collected, used, retained, shared, and protected, the relevant purposes and legal bases for processing, and the rights of data subjects.

Information necessary to fulfil an order may be shared with relevant parties, such as the Seller, shipping provider, and payment service provider, to the extent necessary to fulfil the order, provide the relevant services, and comply with legal obligations, in accordance with the Privacy Policy and applicable laws.

By using the Platform, the User acknowledges having been provided access to the Privacy Policy. This acknowledgement shall not be interpreted as consent to any processing activity that requires a separate legal basis or specific consent under applicable law.

19. Complaints and Contact Information

Customers may contact Bazar Alward Customer Service regarding orders, products, accounts, or other enquiries at:

Email: [email protected]

The Platform may request an order number or other information reasonably necessary to verify the Customer’s identity and process the request.

The Platform aims to address enquiries and complaints within a reasonable period. Resolution may require coordination with the Seller, shipping provider, payment service provider, or another relevant party.

20. Force Majeure and Circumstances Beyond Our Control

The Platform shall not be responsible for delay or failure to perform resulting directly from circumstances reasonably beyond its control, including natural disasters, government actions, telecommunications or payment-system outages, widespread logistics disruptions, or similar events.

The Platform will take reasonable measures to mitigate the effects of such circumstances and resume services when reasonably possible.

This section does not affect mandatory Customer rights or obligations that cannot legally be excluded.

21. Electronic Communications

Users agree that electronic means may be used for communications relating to their accounts, orders, or use of the Platform, including email, SMS, notifications within the Platform, and other registered communication channels.

Users are responsible for maintaining accurate and current contact information.

Electronic notices and communications shall have legal effect where they satisfy the requirements of applicable laws.

22. Electronic Contracting and Records

Users acknowledge that actions completed electronically through the Platform, including creating an account, submitting an order, and accepting these Terms, may constitute an electronic expression of their intention and agreement in accordance with applicable laws in the Kingdom of Saudi Arabia.

The Platform may retain electronic records relating to accounts, orders, payments, acceptances, communications, and other transactions conducted through the Platform in accordance with applicable laws and the Privacy Policy.

23. Amendments to these Terms

Bazar Alward Marketing Company may amend these Terms or related policies where necessary due to operational, commercial, technical, or regulatory changes.

The updated Terms will be published on the Platform together with the date of the latest update.

Where a material amendment directly affects a User’s rights or obligations, the User may be notified through email, their account, or another appropriate electronic method within a reasonable period before the amendment takes effect, depending on the nature of the change.

Continued use of the Platform after the effective date of the updated Terms constitutes acceptance of the updated Terms in relation to future use of the Platform.

Amendments will not apply retroactively in a manner that changes the terms applicable to a purchase completed before the amendment took effect unless required by law or agreed by the relevant parties.

24. Related Policies and Documents

The policies and documents published or referenced through Bazar Alward, to the extent applicable to the User or transaction, form an integral part of these Terms, including:

  • Return and Exchange Policy.
  • Shipping Policy.

  • Marketplace Intermediary Disclosure.
  • Any specific terms applicable to promotions or services offered through the Platform.

If there is a conflict between these Terms and a policy dealing specifically with a particular subject, the provisions that are more specific to that subject will apply to the extent that they do not conflict with applicable law, unless expressly stated otherwise.

25. No Waiver and Severability

Failure by Bazar Alward Marketing Company to exercise any right available under these Terms shall not constitute a permanent waiver of that right.

If any provision of these Terms is determined to be invalid or unenforceable, this shall not affect the validity or enforceability of the remaining provisions.

26. Governing Law and Dispute Resolution

These Terms shall be governed by and interpreted in accordance with the laws and regulations of the Kingdom of Saudi Arabia.

If a complaint or dispute arises, Customers are encouraged to contact Bazar Alward Customer Service first so that the matter may be addressed amicably.
